These Terms & Conditions ("Terms") govern your use of this website and any title search, abstract or property research services ordered from Oleander Abstractors Incorporated or its affiliated brand sites. By using the site or placing an order, you agree to these Terms.
1. Services
We provide research of public records, including title searches, abstracts of title, ownership and encumbrance reports, lien, judgment and tax searches, and foreclosure title searches. The scope, search period and turnaround for each order are those stated on your order or quote. Our services are subject to our Disclaimer, which is part of these Terms.
2. Your information
You agree to give accurate property details (address, parcel ID, county, owner names) and contact information. We are not responsible for errors caused by incomplete or incorrect information you provide.
3. Permitted use of reports
Reports are prepared for the person or company that ordered them and for the stated transaction. You may not resell or redistribute reports or rely on them for a different property or purpose without our written consent. We owe no duty to third parties who receive a report.
4. Fees and payment
Fees are quoted before work begins and are due as stated on your order. Additional charges may apply for rush service, expanded search periods, extra parcels, or copies of recorded documents. Government recording and copy fees are passed through at cost.
5. Turnaround
Turnaround times are estimates. Delays can occur because of public-office closures, record availability, system outages or other causes beyond our control.
6. Cancellations and refunds
Cancellations and refunds are handled under our Refund Policy.
7. Limitation of liability
To the fullest extent permitted by law, Oleander Abstractors' total liability arising from any order or report, whether in contract, negligence or otherwise, will not exceed the fee paid for that report. We are not liable for indirect, incidental, special or consequential damages, including lost profits or lost transactions. Any claim must be made in writing within one (1) year of the report date.
8. Website use
You agree not to misuse the site, submit false requests, attempt unauthorized access, or interfere with its operation. Site content, logos and trademarks belong to Oleander Abstractors or their respective owners and may not be copied without permission.
9. Communications
By submitting a request you agree that we may contact you by email or phone about your order. You can ask us to stop non-essential communications at any time.
10. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
11. Changes
We may update these Terms from time to time. The "Last updated" date above shows the latest version. Continued use of the site after changes means you accept them.
